1. Acceptance of Terms
By downloading, installing, or using the VisionPost mobile application (“App”) and any related services, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App. We reserve the right to modify these Terms at any time; your continued use after such changes constitutes acceptance of the modified Terms.
2. Description of Service
VisionPost is a social media post enhancement and analysis tool that provides heatmaps, color distribution analysis, and AI-generated content (e.g., captions, hashtags, suggestions). The App is designed to help you understand and improve your social content. The App is provided “as is” and we do not guarantee uninterrupted or error-free operation.
3. Eligibility
You must be at least 13 years of age (or the minimum age required in your jurisdiction to consent to use of the App) to use VisionPost. By using the App, you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization.
4. Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:
- Use the App in any way that violates applicable laws or regulations
- Infringe the intellectual property, privacy, or other rights of any third party
- Use the App to create, distribute, or promote harmful, offensive, or illegal content
- Attempt to reverse engineer, decompile, or extract the source code of the App (except where permitted by law)
- Circumvent any security or access controls, or use the App to gain unauthorized access to any system or data
- Use the App in a manner that could damage, disable, or overburden our infrastructure or that of any third party
We reserve the right to suspend or terminate your access to the App if we believe you have violated these Terms or applicable law.
5. Your Content and Intellectual Property
You retain all rights to the content you create or upload within the App. We do not claim ownership of your images, posts, heatmaps, color outputs, or AI-generated suggestions derived from your content. You are responsible for ensuring that you have the necessary rights to use any content you process with the App and that your use complies with the terms of any social platforms you use. VisionPost, its name, logo, and all related materials are our intellectual property and may not be used without our prior written consent.
6. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. AI-GENERATED CONTENT IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND MAY NOT BE ACCURATE OR SUITABLE FOR YOUR USE. USE OF THE APP IS AT YOUR SOLE RISK. WE ARE NOT AFFILIATED WITH, ENDORSED BY, OR SPONSORED BY ANY THIRD-PARTY SOCIAL PLATFORM.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VISIONPOST, ITS DEVELOPERS, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH CASES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
8. Indemnification
You agree to indemnify, defend, and hold harmless VisionPost and its developers, affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App, your content, or your violation of these Terms or any applicable law.
9. Third-Party Services and Platforms
The App may integrate with or reference third-party platforms (such as social networks) or AI services. Your use of those platforms and services is subject to their respective terms and policies. We are not responsible for the availability, content, or practices of third-party services. Any reference to such platforms in the App is for descriptive purposes only and does not imply endorsement or partnership.
10. Termination
You may stop using the App at any time. We may suspend or terminate your access to the App or any part of it at any time, with or without notice, for any reason, including suspected violation of these Terms. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive (including disclaimers, limitation of liability, and indemnification) will survive termination.
11. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App developer is established, without regard to its conflict of law provisions. Any dispute arising from these Terms or the App shall be resolved in the courts of that jurisdiction, except where prohibited by law. You may also have consumer rights under your local law that cannot be waived by contract.
12. General
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision. These Terms constitute the entire agreement between you and VisionPost regarding the App and supersede any prior agreements. We may assign our rights and obligations under these Terms; you may not assign yours without our written consent.
